Outfall Deed of Grants

We are always thinking about new ways to try to get developments adopted quicker and noticed in a recent visit to a client’s office that they were struggling to get their deed of grants in place to allow sewers to be adopted, which in turn is holding up their road adoptions.  We came up with an idea to help them that they have now taken on board.

Background:

Over the last few years, achieving the adoption of roads has become a much lengthier process than it was previously.  One of the reasons for this is that the majority of councils would previously ‘take a view’ on the status of the 104 adoption and still adopt roads.  However nowadays, almost all will insist upon the sewers being adopted (or at least on maintenance) before they will consider taking over the highways and releasing bonds.


The situation has changed recently and the initial focus, first and foremost, has to be on the 104 adoption.  This, coupled with the increase in the need to balance flows and to put water back into the ground, has meant that we increasingly have the situation on many sites where we need to drain to watercourses or ponds or swales which often necessitate crossing third party owned land.  The arrangement of the deed and putting together the necessary information is often a task that is put aside so why not let us do the graft for you which will allow your engineers to move the adoptions forward.


Our proposal:

Is to take each of your developments, whether they are closed or current sites, where the sewers do not drain to an existing adopted system and carry out the following procedures for you:


1. Compare the engineering layout with the conveyance plan to assess if the easement affects any new purchasers.

2. Gain copies of land registry ownership information for affected parties.

3. Gain copies of Ordnance Survey information to enable a land registry compliant deed plan to be prepared.

4. Check dimensions on site where necessary or request an as built survey of the sewer line and level if there appears to be some ambiguity.

5. Prepare the Unilateral Deed of Grant of Easement form (in the case of STW) to suit.

6. Use our best endeavours to contact each respective third party to secure their signatures to the deed.  To correspond with them or their chosen representatives as necessary.

7. Once completed, send copies of the deed to the Water Authority so they can agree the land transfer

8. Arrange for the covenant to be registered with HM Land Registry either directly or via your nominated legal representative. This would then enable you to push ahead with your adoptions and cancellation of bonds and over-run fees.


The above tasks will be handled on our behalf by Hayley White.  Hayley previously worked for a major solicitor in Northampton and is also HR trained and has excellent communication skills and attention to detail.  She has undergone training on each part of the procedure and will be supervised by myself throughout the process.
